Terms and Conditions of Sale

These Terms and Conditions of Sale (the “Agreement”) govern the purchase of goods and equipment from Fox Fold Products Inc. (the “Company”). By placing an order, the “Customer” agrees to be bound by the following terms.

1. Definitions

 

  • Products: All goods, equipment, and supplies sold by the Company.

  • Durable Products: Hardware or equipment, including but not limited to dispensers.

  • Consumable Products: Items intended for replenishment, such as paper refills.

  • Order: Any request to purchase Products via the Portal, email, or formal purchase order.

  • Portal: The Company’s online account management system.

  • Carrier: The third-party shipping provider responsible for Product transport.

2. Ordering and Accuracy

 

To ensure continuity of service, the Company recommends that Customers place reorders upon reaching the final case of Consumable Products.

  • Submission: Orders may be placed via the Online Portal or through established Auto-Reorder schedules.

  • Accuracy: The Customer is solely responsible for verifying the accuracy of the Ship-To Address, Bill-To Address, Product Quantities, and Pricing prior to Order finalization. The Company assumes no liability for errors in information confirmed by the Customer.

3. Fulfillment and Shipping

  • Order Acceptance: The Company reserves up to 5 business day(s) to confirm an Order and maintains the right to refuse or cancel any Order at its sole discretion.

  • Shipping Estimates: Parcel Orders typically ship within 10 business days, and large-scale shipments (LTL/FTL) within 15 business days. These timelines are estimates and do not constitute a guarantee.

  • Cancellations: Cancellation requests must be sent to hello@foxfold.com with “Urgent Cancellation” in the subject line within 12 hours of order placement. Once an order has entered the fulfillment stage, it cannot be canceled or diverted.

4. Delivery, Title, and Risk of Loss

  • Shipping Terms: Unless otherwise specified, all Orders are shipped “Prepaid & Add,” where the Company pays the Carrier and invoices the Customer for the cost.

  • Transfer of Ownership: Title to the Products and the risk of loss pass to the Customer upon delivery to the specified address and the signing of the delivery receipt.

  • Damage Claims: Shortages or visible damage must be documented on the delivery receipt at the time of arrival. The Customer must notify the Company of any discrepancies within 5 business days.

5. Returns and Defective Merchandise Policy

 

Fox Fold Products Inc. maintains a strict return policy to ensure product integrity and operational efficiency.

 

  • Final Sale: All sales of Durable and Consumable Products are final. The Company does not accept returns or exchanges for reasons including, but not limited to, overstocking, incorrect product selection, or change of Mind.

  • Defective Products: Returns are only permitted in the event of a documented manufacturing defect. If a product is deemed defective, the Customer must contact hello@foxfold.com within 5 days of receipt to initiate a claim.

  • Resolution: Upon verification of the defect by the Company, we will, at our discretion, provide a replacement, repair the item, or issue a credit. Returns sent without prior written authorization will be refused.

6. Limited Warranty

 

Durable Products are covered by a 12 months limited warranty against defects in materials and workmanship.

Note: This warranty is rendered void if the Customer utilizes third-party parts or supplies not expressly authorized by Fox Fold Products Inc.

7. Limitation of Liability and Force Majeure

  • Force Majeure: The Company shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control (e.g., acts of God, strikes, or supply chain disruptions).

  • Liability Limit: In no event shall the Company be liable for any indirect, incidental, or consequential damages. Total liability shall not exceed the purchase price of the specific Order in question.
